Jawatan seorang hakim melibatkan kepercayaan orang awam dan amanah itu jangan sesekali dikhianati, kata bekas hakim Mahkamah Rayuan Datuk Mohd Hishamudin Mohd Yunus hari ini.

Bercakap kepada hadirin sebuah forum, beliau menggesa hakim-hakim agar berani mempertahankan kebebasan mereka dalam melaksanakan tanggungjawab.

“Apa yang hakim mahukan? Mereka mahu dihormati atau dipandang enteng warganegara?

“Benar mereka perlu berhadapan eksekutif yang amat berkuasa, berkuasa melantik, menaikkan pangkat malah memecat hakim dalam kes tertentu,” katanya.

Beliau berkata demikian sewaktu menjawab soalan hadirin tentang cara melindungi hakim daripada dimangsakan dalam sistem sekarang.

Menurut Hishamudin, situasi itu tidak patut menjadi alasan buat hakim untuk tidak mempertahankan kebebasan mereka.

“Orang yang suka menurut perintah tidak patut menerima lantikan menjadi hakim.

“Kehakiman adalah kepercayaan awam dan ia jangan sama sekali dikhianati,” katanya. Read more

KUALA LUMPUR: Certain people who deserve to be appointed to the apex court were not promoted, claimed retired Court of Appeal Judge Mohamad Ariff Yusof at a public forum.

Ariff stressed during the forum, organised by the Bar Council, that there were weaknesses in the system. “The system should be reviewed.”

According to him, the major weakness in the judiciary was appointments can only be made upon the recommendation of the Prime Minister. “The weak link lies in the need to have the recommendation referred to the Prime Minister,” he said. “That’s where it is. I don’t dare say anything more.”

“There are those who deserve to be at the apex (court) but are not appointed. Some thought should be given to how to improve the system.” Read more

The position of a judge is one of public trust and on no account should that trust be betrayed, retired Court of Appeal judge Datuk Mohd Hishamudin Mohd Yunus said today.

He also told the audience at a forum that judges should be courageous and assert their independence in carrying out their duties.

“What do the judges want? They want to be respected or they want to be looked down upon by the citizens?

“It is true that there’s a powerful executive to contend with, who has the power of appointment, promotion and even removal of judges in some cases,” he said, in answer to a question from the audience on how to protect judges from being victimised.

Hishamudin said the threat of being victimised should not be reason for judges to refuse to assert their independence.

“A person who is meek should not accept the appointment to be a judge.

“Judgeship is a public trust and this trust must not be betrayed,” he said. Read more

Seorang bekas hakim kanan mengecam tindakan Tan Sri Khalid Abu Bakar dalam kenyataannya tentang seminar anti-Kristian, berkata yang ketua polis negara itu sepatutnya bersikap lebih profesional dalam mengeluarkan kenyataan.

Hakim bersara Mahkamah Rayuan Datuk Mohd Hishamudin Mohd Yunus berkata Khalid perlu lebih berhati-hati kerana dia ialah pengawal kesejahteraan masyarakat apabila mengeluarkan kenyataan mengenai sebuah seminar yang diadakan di Universiti Teknologi Mara (UiTM) Sabtu lepas.

Malaysia needs greater maturity in its view of human rights, which should not be seen as a hindrance to society, retired Court of Appeal judge Datuk Mohamad Ariff Md Yusof said today.

Human rights should not be seen as an impediment, he added, when speaking at a forum on “Whither the Federal Constitution – Do fundamental and minority rights matter?” organised by the Bar Council in Kuala Lumpur.

“The country should be matured enough to respect minority rights, fundamental rights and human rights. We had a good run on human rights, why do we want to shoot ourselves in the foot.

“When someone throws a balloon you should laugh it off and not prosecute the person. We need to be mature,” he added, referring to charging of dancer Bilqis Hijjas who had dropped yellow balloons bearing the words “democracy”, “free media” and “justice” at an event in a mall in August with Prime Minister Datuk Seri Najib Razak attended with his wife Datin Seri Rosmah Mansor in attendance. A former senior judge has rapped Tan Sri Khalid Abu Bakar over his response to last weekend’s anti-Christian seminar, saying the inspector-general of police should be more professional in his remarks.

Retired Court of Appeal judge Datuk Mohd Hishamudin Mohd Yunus said Khalid should be mindful that he was the custodian of public conscience when issuing statements on the seminar held at University Teknologi Mara (UiTM) last Saturday.

“He should be more professional in what he says. He should give the appearance that ‘I am the IGP, I am neutral and I am the custodian of public conscience’,” Hishamudin told a forum organised by the Bar Council in Kuala Lumpur today. Read more

As the peninsula’s east coast experiences its monsoon season, PKR’s Kuantan MP Fuziah Salleh warns that the rains will compound an already alarming situation arising from unregulated and indiscriminate bauxite mining.

Mining activities in three parliamentary constituencies in the east coast state of Pahang during the monsoon might lead to a toxic flood worse than the deluge which displaced more than 20,000 households two years ago, she said.

“The monsoon season is here. The rainfall will be more than usual. It will last longer as well. Floods may occur if Sungai Kuantan overflows.

“Imagine the mud containing toxic substances and heavy metals from bauxite activities in those areas flowing into the rivers.

“Four hours of non-stop rain caused a wall at a bauxite pond to give way, what more if it rains non-stop for four or seven days,” she said, referring to the incident last month when the wall at a bauxite pond in Bukit Goh collapsed, causing polluted water to flood the village in the area.
