Ketika Syria dibom, Rohingya dibakar hidup-hidup, seluruh rakyat Malaysia, daripada pucuk pimpinan hingga golongan marhaen, menzahirkan keprihatinan sebagai saudara seagama yang bersahabat di dunia, bersaudara di syurga.

Begitu juga ketika Paris meledak apabila tembakan rambang dilepaskan di bar. Seluruh dunia menunjukkan keprihatinan mereka dengan mengutus doa dan mengecam pelaku, menolak keganasan dengan menggunakan alasan kemanusiaan.

Ketika Harambe (seekor gorila yang terpaksa ditembak mati bagi menyelamatkan seorang kanak-kanak yang terjatuh di dalam kurungannya) dibunuh, keprihatinan dunia seolah-olah menunjukkan kemanusiaan itu masih segar di bumi pelbagai bangsa ini.

Bagaimanapun, sangkaan itu meleset apabila berlaku tragedi di Kelantan yang melibatkan kaum Orang Asli. Hak sebagai warganegara dan manusia dicerobohi.

Kisah yang diceritakan mungkin tidak jelas kerana dikaburi media dan pemanipulasi cerita. Tetapi secara ringkasnya, kita langsung tidak kisah tentang apa yang terjadi terhadap mereka yang juga rakyat Malaysia.

Kisah yang terjadi di Kelantan ini bukannya baharu wujud 2-3 hari lalu. Kisah balak ini sudah bertahun-tahun. Read more

PETALING JAYA: Pindaan Enakmen Pentadbiran Agama Islam 2016 oleh Dewan Undangan Negeri Perlis yang membenarkan penukaran unilateral kanak-kanak bawah umur bergantung kepada keputusan Mahkamah Persekutuan, kata peguam.

Fahri Azzat berkata, rakyat Malaysia terpaksa menunggu keputusan mencabar undang-undang dibawa guru tadika M Indira Gandhi, yang memohon membatalkan sijil penukaran agama 3 anaknya.

“Enakmen Perlis akan tidak akan mengikut Perlembagaan jika mahkamah tertinggi membuat keputusan memihak kepada Indira. Undang-undang negeri akan menjadi sah jika rayuannya ditolak,” katanya kepada FMT.

Beliau berkata, prinsip undang-undang yang ditubuhkan Mahkamah Persekutuan akan mengikat negeri.

Fahri berkata demikian sebagai respons kepada tindakan Dewan Undangan Negeri Perlis yang meluluskan pindaan itu dengan majoriti 13-1. Read more

KUALA LUMPUR: Barisan Nasional component party leaders have slammed the Perlis government for passing a legislation to allow for unilateral conversion of a minor to Islam.

MIC president Datuk Seri Dr S. Subramaniam said unilateral conversions had been “the central core of discord” in many cases, citing kindergarten teacher Indira Ghandi’s custodial dispute case in 2015.

“While the federal cabinet has been trying to find a permanent solution to an issue which has been identified as a major thorn in inter-religious relationships in this country, this act by a BN government is a major step backwards to religious harmony in this country.

“It is going to cause greater disunity among the people of Malaysia,” he said in a statement today. Prior to the amendment, Perlis’ Administration of the Religion of Islam Enactment 2006 required the consent of both the father and mother for the conversion of a child under the age of 18.

It was reported that Section 117 of the enactment, with the phrase in the Malay version “father and mother or guardian” was changed to “father or mother or guardian” to give consent for children under 18 years old to be converted to Islam.

The amendment comes just weeks after a bill was tabled in Parliament to prevent from unilateral conversion of a child. Read more

PETALING JAYA: Undang-undang persekutuan mengatasi undang-undang negeri sekiranya berlaku ketaktekalan, kata Menteri di Jabatan Perdana Menteri Datuk Seri Azalina Othman.

Maka, sekiranya kerajaan persekutuan berjaya meminda Akta Membaharui Undang-Undang (Perkahwinan dan Perceraian) 1976 (LRA), pindaan enakmen Perlis yang didakwa membolehkan anak diislamkan dengan persetujuan ibu atau bapa sahaja tidak boleh boleh digunakan.

Menurut Azalina, Dewan Undangan Negeri Perlis berhak meminda Enakmen Pentadbiran Agama Islam 2006.

“Pada masa yang sama, rang undang-undang yang dibentangkan kerajaan untuk meminda LRA tepat pada masanya dan langkah yang positif.

“Sekiranya pindaan diluluskan, ia akan menjadi undang-undang persekutuan.

“Adalah dimaklumkan Perkara 75 Perlembagaan Persekutuan menyatakan mana-mana undang-undang negeri yang berlawanan dengan undang-undang persekutuan, maka undang-undang persekutuan mengatasinya,” katanya beliau dalam satu kenyataan hari ini.

UN experts call on Malaysia to stop targeting human rights defenders under national security legislation

GENEVA (9 December 2016) – Malaysia must protect all of its human rights defenders instead of targeting them under national security legislation, said today a group of United Nations human rights experts*.

Their call comes after weeks of heightened pressure on BERSIH 2.0 – a coalition of civil society organizations campaigning for clean and fair elections – and the organizers of the Bersih 5 rally, held in three cities across Malaysia on 19 November 2016.

“We are particularly concerned at the arrest of Maria Chin Abdullah, the Chairperson of BERSIH 2.0, on 18 November 2016 and her subsequent detention under the Security Offences Special Measures Act 2012 (SOSMA),” the experts said.

SOSMA specifically states that no individual will be arrested under the law for ‘political activity’ or ‘belief’ and that its use is strictly restricted to matters pertaining to public order and national security. Read more

KANGAR: Pas assemblyman Mohd Shukri Ramli voiced support yesterday for an amendment to a bill allowing unilateral consent of either a mother or father for the conversion of children under 18 years old to Islam – despite objections from PKR Indera Kayangan assemblyman Chan Ming Kai.

The Sanglang assemblyman had seconded the Islamic Religion Administration Enactment (Amendment) 2016 Bill.

Under the amended enactment, the word “ibu dan bapa” (mother and father) was changed to “ibu atau bapa” (mother or father) in the Malay version.

The English version of the enactment states “parent”, referring to subsection 117(b), which reads that a (child) who is not a Muslim may convert to Islam if he is of sound mind.

Chan stood up to oppose, while MCA’s Khaw Hock Kong was seen leaving the House when the Bill was tabled. Read more

Ambiga quizzed over funding

KUALA LUMPUR: Police have recorded the statement of Datuk Ambiga Sreenevasan (pic) over links to the Open Society Institute (OSI), which is part of the Open Society Foundations (OSF) founded by American hedge fund billionaire George Soros.

The former Bersih chairman was questioned for about an hour yesterday after she arrived at about 11am at Bukit Aman accompanied by lawyer N. Surendran.

“I only know that I was called in as the former Bersih chairman for matters relating to funding and OSI,” she said. Read more

The ongoing investigations into foreign funding of Bersih and other NGOs under Section 124C of the Penal Code is selective and baseless.

Bersih has at all times been transparent about its funding and its accounts. We have always made it clear that Bersih received funds from Open Society Institute (OSI) in 2011 in the sum of US$25,000 and from the National Democracy Institute (NDI) in the sum of US$9,690. Both sums were used in election-related projects.

These allegations are not new. As a result of a suit filed by Bersih and other NGOs in 2012, the New Straits Times issued an apology to Bersih and other NGOs in November 2013 for their baseless allegations of a plot to destabilise the government by using funds allegedly received in the amount of RM20 million.

All the documents relating to the funds received by Bersih were filed in court in that suit.

The repeated accusation that there is a conspiracy of sorts to topple the government makes no sense when Bersih’s primary demand since its inception, has been for free and fair elections and for strong institutions.

Every activity of Bersih is geared towards these demands. Workshops and training are organised. Voters’ rights are promoted. Representations are made to the EC. Election observers are trained. Peaceful assemblies are organised. Sometimes Bersih has had to go to court.

These are all legitimate activities permissible under the law carried out by Bersih and supported by the endorsing NGOs. Read more

PETALING JAYA: Kriteria pelantikan ke dalam Dewan Negara seolah-olah menyimpang daripada objektif digariskan Perlembagaan Persekutuan, kata pakar undang-undang dan menegaskan ia kini mejadi tempat untuk kroni kerajaan atau parti.

Dr Abdul Aziz Bari berkata, Dewan Negara, sebagai komponen ke-2 Parlimen, adalah untuk ahli masyarakat yang tidak boleh dipilih ke Dewan Rakyat.

Dan ini katanya, termasuk wakil kumpulan minoriti seperti Orang Asli, pesara atau kumpulan profesional.

Tetapi Aziz menegaskan Dewan Negara kini nampaknya menjadikan ia tempat untuk kroni kerajaan atau parti.

KUALA LUMPUR: The Malaysian Anti-Corruption Commission ( MACC) has adopted a set of new goals in its aim to eliminate corruption by 2020.

MACC chief commissioner Datuk Dzulkifli Ahmad said the agency will address key issues on corruption plaguing critical sectors in the country to ensure they are all graft-free.

He said this encompasses public service agencies, enforcement agencies, state and local authorities, government-linked companies, the private sector and the banking sector, among others. “International Anti-Corruption Day is a platform for us to reflect on and draft new strategies and plans to combat corruption in the country.

“Hence, we have come up with new goals (to create a graft-free nation, particularly in the critical sectors), in (four) years.

“In order to achieve said goals, we have to focus on enforcement and confiscation of proceeds of corruption, to return them (proceeds) to the country (government).

“Since I assumed my position as MACC chief commissioner in Aug 2016, we have laid out several strategies and carried out aggressive enforcement activities, which have led to successful and positive outcomes,” he said in his opening speech during a forum held in conjunction with International Anti-Corruption Day 2016 here today.
