MP takes Pandikar to court for rejecting 1MDB questions

KUALA LUMPUR: Petaling Jaya Selatan MP Hee Loy Sian has filed a lawsuit against Dewan Rakyat Speaker Pandikar Amin Mulia and the House secretary over the rejection of his questions related to 1MDB.

The PKR lawmaker is seeking a court declaration that Pandikar’s decision to reject his questions related to 1MDB dated July 21, be made null and void.

Hee had requested to ask the government whether it had raised any objection on the United States Department of Justice’s (DoJ) forfeiture suit. He also wanted to know the whereabouts of businessman Low Taek Jho (Jho Low) as well as the status of Jho Low’s citizenship as he was alleged to have more than one.

He claimed Pandikar’s action in rejecting his questions on 1MDB had breached his constitutional rights and the rights to free speech in the Dewan Rakyat.“I received a letter from Dewan Rakyat secretary (Roosme Hamzah) on July 21 over the rejection of my questions.

“However, the reasons they gave for rejecting my questions does not make sense,” he told reporters after filing his lawsuit at the High Court registry here.

 Lawyer and fellow PKR lawmaker N Surendran said that Hee was the first MP to take legal action against Pandikar for rejecting questions in Parliament and that whatever decision made by the court will bind on other MPs who take action against the Speaker in the future.

Last week, Pandikar told reporters in Parliament that he had allowed 19 questions on 1MDB to be raised in the current sitting.

He also dismissed claims by opposition MPs that he had arbitrarily rejected 30 questions as being false accusations and made deliberately to “blacken his image”.

Opposition leader and Permatang Pauh MP Dr Wan Azizah Wan Ismail had earlier urged Pandikar to review his role as he had failed to carry out his responsibility as Speaker with integrity.
