DECEMBER 15 ― 1. We, members of Civil society (represented by the organisations listed below) are greatly concerned by the recent developments pertaining to the arrest of Puan Maria Chin Abdullah under the Security Offences (Special Measures) Act 2012, the summoning of activists from Suaram, Lawyers for Liberty and Empower for investigations, the police raid and seizure of the offices of Bersih and Empower and the numerous news reports making allegations against various organisations in respect of the foreign funding, including the Malaysian Bar Council.

2. We are also perturbed by news reports of the Home Minister Datuk Seri Ahmad Zahid Hamidi announcing the formation of a task force to probe into NGO funding and accusing them of enticing revolutions to topple the present government and news reports of Deputy Home Minister Datuk Nur Jazlan’s reply to the numerous concerns regarding local human rights issues raised by Maina Kiai the United Nations Special Rapporteur on the rights to freedom of peaceful assembly and of association in his recent visit to Malaysia. MEMORANDUM: Masyarakat Sivil Menuntut supaya Kerajaan Menghentikan Gangguan dan Stigma terhadap NGO (Badan Bukan Kerajaan)

  1. Kami, ahli-ahli Masyarakat Sivil (diwakili oleh organisasi-organisasi yang dilampirkan di bawah) amat mengambil berat terhadap perkembangan terkini berkenaan tangkapan dan tahanan Puan Maria Chin Abdullah di bawah Akta Kesalahan Keselamatan (Langkah-Langkah Khas) 2012 baru-baru ini, panggilan aktivis SUARAM, Lawyers for Liberty dan EMPOWER untuk siasatan polis, serbuan dan penyitaan pejabat BERSIH dan EMPOWER, serta pelbagai laporan media berkenaan dakwaan negatif dana asing terhadap pelbagai organisasi, termasuklah Majlis Peguam Malaysia.
  1. Kami turut mengambil berat terhadap pengumuman Menteri Dalam Negeri Dato’ Seri Ahmad Zahid Hamidi yang satu pasukan tindak khas (task force) telah ditubuhkan untuk menyiasat dana-dana NGO dan dakwaan bahawa NGO menyemarakkan revolusi untuk menjatuhkan kerajaan serta jawapan Timbalan Menteri Dalam Negeri Datuk Nur Jazlan terhadap isu-isu hak-hak asasi tempatan yang dikemukakan oleh Encik Maina Kiai, Perwakilan Khas Pertubuhan Bangsa-Bangsa Bersatu (PBB) bagi Kebebasan Berkesatuan dan Perhimpunan Aman, semasa lawatannya ke Malaysia baru-baru ini. Pengumuman dan jawapan menteri-menteri tersebut telah dilaporkan didalam media tempatan.

It was handed to Senator Datuk Paul Low Seng Kuan, the Minister in the Prime Minister’s Department in charge of Governance, Integrity and Human Rights and Datuk Nur Jazlan Mohamed, Deputy Minister of Home Affairs on the roundtable organized by IDEAS on “Ensuring the accountability and integrity in CSO funding” on 15 Dec 2016.

Masyarakat Sivil menuntut
ketelusan dan akauntabiliti mengenai 1MDB

 

1. Kami, anggota NGO (badan bukan kerajaan seperti yang disenaraikan di bawah), berasa amat bimbang akan perkembangan terkini mengenai isu 1 Malaysian Development Berhad (1MDB).

2. Permohonan untuk menyita aset yang dilakukan oleh Jabatan Kehakiman Amerika Syarikat (US DoJ) dan rampasan aset oleh pihak berkuasa di Switzerland dan Singapura telah mendedahkan magnitud dan skala penyelewengan berperingkat antarabangsa terhadap rakyat Malaysia akibat kemunculan isu 1MDB. Oleh sebab ini, kedudukan, reputasi dan ekonomi Malaysia terjejas teruk. Dengan itu, keyakinan pelabur-pelabur Malaysia dijangka akan semakin berkurangan. Profil Malaysia di persada antarabangsa sekarang dijejas oleh gara-gara sifat tamak beberapa pegawai Malaysia yang telah membawa kepada penyitaan asset yang terbesar dilakukan dibawah Inisiatif Pemulihan Aset Kleptokrasi (“Kleptocracy Asset Recovery Initiative“) Amerika Syarikat.

3. Rakyat Malaysia amat terkejut dengan tindakan DoJ apabila pegawai tertinggi yang terlibat dalam kemelut ini tidak dinamakan, tatapi hanya diberikan kod “Malaysian Official 1”. Hal ini lebih menghairankan memandangkan kerajaan Malaysia bersifat bisu walaupun isu ini terbongkar diseluruh dunia. Menteri-menteri yang bertutur mengenai isu ini hanya berniat untuk mempertahankan 1MDB dan individu yang tersabit yang hanya dikenali sebagai “Malaysian Official 1”. Selain itu, sebarang perbincangan berkenaan penyelewengan terbesar dana rakyat tidak dilakukan.

4. Keadaan ini jelas tidak memuaskan dan mesti ditangani dengan segara. Isu kronik ini patut diberi kepentingan dan harus ditangani secara adil, telus dan bertanggungjawab. Skandal 1MDB yang berpanjangan ini telah dan akan terus menjejaskan kebajikan rakyat Malaysia dan mendatangkan ketidakstabilan politik dan ekonomi di Malaysia. transparency and accountability on 1MDB

 

1. We, members of Civil Society (represented by the Organizations listed below) are greatly concerned by the recent developments pertaining to the 1 Malaysian Development Berhad (1MDB).

2. The recent application to seize assets by the United States Department of Justice (US DoJ) and the seizure of assets by authorities in Switzerland and Singapore have brought to the fore the magnitude and international scale of the fraud perpetrated upon the people of Malaysia through 1MDB. Malaysia’s international standing, reputation and our economy have been badly affected. Investor confidence in Malaysia will wane. Malaysia’s profile abroad is now one where the acts of greedy officials in Malaysia have caused in the U.S., the “largest single action ever brought under the Kleptocracy Asset Recovery Initiative”.

3. Malaysians were deeply shocked by the US DoJ action where top officials of the country have been code-named. This has never been seen before in our country. Yet the response by the government has been muted. Ministers who spoke merely defended 1MDB and the person described as Malaysian Official 1. The silence about the massive looting of the rakyat’s funds is deafening.

4. This unsatisfactory state of affairs must cease. It is now of paramount importance for the matter to be addressed immediately in a fair, transparent and accountable manner as the prolonged 1MDB saga has led to political and economic instability in Malaysia and has jeopardized the welfare of the Malaysian people. Masyarakat sivil memandang berat Rang Undang-Undang Majlis Keselamatan Negara 2015 (Rang Undang-Undang MKN) yang diluluskan secara tergesa-gesa di Dewan Rakyat pada 3 Disember 2015.

Rang Undang-Undang ini memberi kesan yang buruk kepada rakyat Malaysia dan merupakan ancaman yang belum pernah berlaku sebelum ini terhadap demokrasi berparlimen di Malaysia.

Mengapa perlu ada undang-undang yang seluas ini, terutamanya apabila ianya dilakukan secara tergesa-gesa, tanpa sebarang justifikasi, hebahan mahupun perundingan?

Pembentangan Rang Undang-Undang ini merupakan suatu langkah yang amat berbahaya bagi Malaysia kerana ia menumpukan kuasa luar biasa ke tangan hanya seorang ahli cabang Eksekutif Kerajaan. Mekanisme semak dan imbang yang biasanya didapati dalam mana-mana demokrasi berparlimen adalah sama ada tidak wujud ataupun terjejas teruk di Malaysia.

MEMORANDUM to Members of Dewan Negara on the National Security Council Bill 2015

Malaysian civil society organisations view with serious concern the National Security Council Bill 2015 (NSC Bill) that was rushed through Dewan Rakyat on 3rd December 2015.

This Bill has dire consequences for the people of Malaysia and represents an unprecedented threat to what remains of parliamentary democracy in Malaysia.

Why is there a need for such a sweeping piece of legislation especially since it was done in such haste, without any justification, publicity or consultation?

The tabling of this Bill represents an extremely dangerous step for Malaysia as it concentrates extraordinary powers within the hands of a single member of the Executive arm of Government. Mechanisms of check and balance normally found within parliamentary democracies are either absent or severely compromised in Malaysia.

No person or entity should have absolute and unfettered powers. Concentration of power leads to the temptation for abuse, particularly in times of political crisis. The NSC Bill represents a quantum leap towards a dictatorship and a military-police state.

The serious ramifications of this Bill call for further and extensive consideration by the Dewan Negara. Read more

Rang Undang-undang ini memberi kesan yang buruk kepada rakyat Malaysia. Kami membantah cara ianya sedang digegas di Parlimen supaya diluluskan. Kesan Rang Undang-undang ini yang dikenakan terhadap rakyat Malaysia memerlukan pertimbangan yang lebih lanjut dan mendalam. Read more
