KUALA LUMPUR: A salesman, who was detained under the Prevention of Crime Act 1959 (Poca), has filed a habeas corpus application at the High Court here to secure his release.
R. Vishnu Moorthy, 38, has named Bukit Aman Commercial Crime Investigation Department director Datuk Acryl Sani Abdullah Sani, Inspector-General of Police, Home Minister and the Public Prosecutor as respondents.
In his notice of motion that was filed and affirmed by his wife A. Magaswarie on Friday, he claimed that the detention order dated March 29 in relation to a foreign exchange investment case was in breach of Article 5(1) read together with Article 4 of the Federal Constitution. Read more →
KUALA LUMPUR: The wife of a salesman is challenging the 21-day remand order against him under the Prevention of Crime Act 1959 (Poca).
A. Magaswarie, who is six months’ pregnant, filed the notice of appeal on behalf of R. Vishnu Moorthy, 38, who was detained on March 29 over a foreign exchange investment scheme, in which some 20,000 investors were said to have been cheated.
In the certificate of urgency, Magaswarie’s counsel P. Uthayakumar said Vishnu Moorthy was wrongly detained without trial under Poca.
Vishnu Moorthy, now detained at the Jalan Tun Razak police station, said he is not satisfied with the magistrate’s order on March 29 and asked for the court to dispose the case as soon as possible. Read more →

PUTRAJAYA: Rayuan Pengerusi Bersih 2.0 Maria Chin Abdullah supaya Mahkamah Persekutuan membuat keputusan mengenai kesahihan penahanannya mengikut Akta Kesalahan Keselamatan (Langkah-langkah Khas) 2012 (Sosma) tahun lepas, ditolak hari ini.
Panel 5 hakim Mahkamah Persekutuan, yang diketuai Hakim Besar Malaya yang baharu Tan Sri Ahmad Maarop, sebulat suara menolak rayuannya berhubung permohonan habeas corpus beliau berhubung penahanannya selama 10 hari mengikut Sosma.
Panel itu dianggotai Hakim-hakim Mahkamah Persekutuan Tan Sri Zainun Ali, Tan Sri Azahar Mohamed, Tan Sri Zaharah Ibrahim dan Datuk Balia Yusof Wahi.
Maria, 60, dibebaskan pada 28 November tahun lepas setelah ditahan 10 hari mengikut Sosma walaupun perintah yang dikeluarkan terhadapnya mengarahkan supaya beliau ditahan selama 28 hari.
Pada 29 November tahun lepas, Mahkamah Tinggi menolak permohonan habeas corpus beliau, sehari selepas pembebasannya, atas alasan beliau tidak lagi ditahan. Read more →
The High Court in Kuala Lumpur will next Tuesday hear Bersih chairperson Maria Chin Abdullah’s habeas corpus application to challenge her detention under the Security Offences (Special Measures) Act 2012.
Judicial Commissioner Nordin Hassan fixed the date in chambers today after he disallowed a request by Supt Tham Lai Kuan, inspector-general of police, the home minister and government to be given seven days to reply to the affidavit filed by Maria’s son Azumin Mohamad Yunus.
The said hearing has been fixed for hearing on Tuesday, 29 November at 2pm at the Kuala Lumpur High Court.

KUALA LUMPUR, Nov 22 ― The family of Bersih 2.0 chairman Maria Chin Abdullah today submitted a habeas corpus application to the High Court here asking it to compel the police to release her from a 28-day detention order.
Police detained Maria on November 18 under Section 124C of the Penal Code that criminalises the attempt to commit activities detrimental to parliamentary democracy, and invoked the Security Offences (Special Measures) Act, or Sosma, for the arrest.
The Sosma invocation permits the police to hold individuals for up to 28 days without trial.
Maria’s eldest son, Azumin Mohd Yunus, 23, filed the affidavit on behalf of the family.
