Since 1950, the world marks 10th December as Human Rights Day.  It is a day to create awareness to  fundamental human rights, in particular as set out in the Universal Declaration of Human Rights (UDHR) as the common standard of achievement for all peoples and all nations.

This year, the National Human Rights Society (HAKAM),  in collaboration with The Malay Mail Online, is pleased to gift you 7 articles, daily from 10 to 16 December 2015 in celebration of Human Rights Day 2015, aimed at bringing attention to selected and specific interest areas concerning human rights in Malaysia.

“Kanak-kanak tidak perlu didengari, jika dilihat cukup”…. “Siapa memberi kamu kuasa untuk menjadi boss saya?”… “Jika dirumah saya dan dibawah jagaan saya, peraturan saya yang mesti diikuti”… “Tetapi saya mempunyai hak juga”…. “Sudah pasti ditampar oleh atuk dan nenek kamu jika saya biadap seperti mu”.

Kanak-kanak sering dianggap “insan kecil”. Adakah kita menganggap kanak-kanak sebagai seorang individu yang mempunyai hak asasi manusia yang sepenuhnya, tiada bezanya dengan insan dewasa?

Ya, seharusnya begitu.

Hak asasi manusia diberikan kepada semua insan, yang bererti kanak-kanak mempunyai hak asasi manusia yang sama seperti orang dewasa. Hak dan kebebasan asasi yang termaktub di dalam Perlembagaan Persekutuan kita berhak dinikmati oleh semua rakyat, dan ini termasuk kanak-kanak.

Kecuali, kanak-kanak menerima hak tambahan kerana mereka istimewa. Read more

OPINION, Dec 15 ― “Children are meant to be seen, not heard”…”Who made you the boss of me?” …”Under my roof, it is only my rules”… “ But I have rights! “Your grandparents would have given me two tight slaps if I had a smart mouth like yours”.

A child is often seen as a “little human being”.

Do we regard a child as an individual with full human rights, no different to an adult human?

We should.

Human rights apply to everyone, which means children have the same human rights as adults. The fundamental rights and liberties enshrined in our Federal Constitution are accorded to all citizens, and that includes children.

Kita mungkin pernah membaca berita ini sepintas lalu, tetapi fakta berikut wajar diulang semula – antara bulan Oktober 2014 hingga September 2015, 271 pembunuhan insan pelbagai transgender telah dilaporkan, satu statistik global yang diumumkan pada Hari Peringatan Transgender yang jatuh pada 20 November setiap tahun untuk memberi penghormatan dan memperingati nyawa yang terkorban dalam tindakan jenayah keganasan anti-transgender.

Para aktivitis Malaysia percaya bahawa insan transgender juga menjadi mangsa pembunuhan di negara ini tetapi pihak berkuasa tidak mengiktiraf identiti jantina insan yang terbunuh dan mengiktiraf pembunuhan sebagai jenayah kebencian. 1

Nyawa yang sengaja dikorbankan kerana anda ingin memilih jalan hidup sendiri pastinya tidak adil. Namun kita diyakinkan bahawa hak terhadap kehidupan, kebebasan dan keselamatan diri yang termaktub dalam Perkara 3 Deklarasi Hak Asasi Manusia Sejagat (UDHR) wajar dinikmati oleh SEMUA insan, bukan hanya mereka yang kita anggap layak menikmati hak ini. Sebelum Perkara 3, Perkara 1 UDHR mengisytiharkan bahawa “all human beings are born free and equal in dignity and rights” dan Perkara 2 UDHR menjanjikan bahawa “everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status”. OPINION, Dec 14 — We may have just glanced over it, but here it is again — between October 2014 and September 2015, there were 271 reported killings of transgender diverse persons, a global statistic released on Transgender Day of Remembrance, which falls on November 20 every year to honour and remember the lives lost in criminal acts of anti-transgender violence.

Malaysian activists believe that transgender persons have been killed here. However, the authorities did not recognise the murdered person’s gender identity and recognise the killing as a hate crime.

A life taken away deliberately because you are living your truth cannot be just.

Yet, we are assured that the right to life, liberty and security of person is enshrined in Article 3 of the Universal Declaration of Human Rights (UDHR) applies to ALL persons, not whom we think deserves to enjoy this right. Read more

Pada 2014, Persatuan Peguam Wanita (“the Association of Women Lawyers (AWL)” dengan usahasama Suruhanjaya Hak Asasi Manusia (SUHAKAM) dan Pertubuhan Pertolongan Wanita (WAO) telah mengendalikan satu kaji selidik bertajuk “51%! Is it a Level Playing Field?” (“51%! Adakah ini membolehkan Persaingan yang Adil?”)

51% Badan Peguam Malaysia terdiri oleh peguam wanita. Baguslah. Akan tetapi, seperti dalam bidang korporat antarabangsa, wanita merana di rangka bawahan. Peguam wanita membentuk 68% rangka bawah bidang undang-undang (tidak termasuk rakan kongsi firma guaman undang-undang). Sejauh mana 68% ini bertungkus lumus menjadi rakan kongsi firma guaman undang-undang? 42%. Dan hanya 25% perunding pakar undang-undang (iaitu peguam berpengamalan dan hakim) adalah wanita.

Adakah terdapatnya siling kaca (“glass ceiling”) dalam profesion yang bertugas menegakkan kesaksamaan dan keadilan? Read more

OPINION, Dec 13 — In 2014, the Association of Women Lawyers (AWL) conducted a survey in collaboration with  Human Rights Commission, Malaysia (SUHAKAM) and Women’s Aid Organisation (WAO) : “51 per cent! Is it a Level Playing Field?”

Fifty-one per cent of the Malaysian Bar are women. Wonderful. But like the international corporate environment, women tend to languish at the bottom. Sixty-eight per cent of legal assistants, i.e. the bottom rung of the Bar are women. How many stay on long enough to become partners? Forty-two per cent. Only 25 per cent of consultants (experienced lawyers or judges) are women.

Is there a glass ceiling in the profession which has sworn to uphold equality and fairness?

The French Bar lost out when IMF head Christine Lagarde was told by the French firm she worked for she would never make partner because she was a woman. So she left and ultimately became Chairperson of one of the largest law firms, Baker McKenzie. You know what happened next.

KESIMPULANNYA, HUKUMAN MATI MANDATORI BUKAN HALANGAN EFEKTIF TERHADAP PERBUATAN SALAH DAN ADALAH BERTENTANGAN DENGAN HAK SETIAP INDIVIDU UNTUK HIDUP

gallowsRamai yang telah lupa mengenai kes salah sabitan S. Karthigesu yang telah didakwa, dibicara dan didapati bersalah kerana membunuh Jean Perera Sinnappa yang berlaku di dalam tahun 1979. Karthigesu merupakan suspek tunggal pembunuhan tersebut.

Perbicaraan pembunuhan itu telah mengambil masa 38 hari. Saksi utama pendakwaan ialah Bhandulananda Jayatilake. Jayatilake telah memberi keterangan bahawa beliau telah menyaksikan Karthigesu menjerit bahawa Jean “tidak berhak untuk hidup”. Hakim perbicaraan menganggap kata-kata ini sebagai bukti yang menunjukkan beliau bersalah. Tiada sebarang bukti dijumpai untuk mengenal pasti secara langsung siapakah pembunuh di dalam kes ini. Senjata pembunuhan juga tidak pernah ditemui walaupun pihak polis telah cuba mencarinya dengan sedaya-upaya.

Karthigesu telah dijatuhkan hukuman mati mandatori oleh Hakim perbicaraan. Beliau telah merayu kepada Mahkamah Persekutuan terhadap sabitan dan hukuman mati yang dijatuhkan terhadapnya. Empat hari selepas sabitan Karthigesu, Jayatilake yang merupakan saksi utama pendakwaan telah tampil ke hadapan. Beliau telah membuat satu pengakuan bahawa dia telah bercakap bohong. Beliau tidak menyaksikan kononnya Karthigesu menjerit yang telah membuktikan Karthigesu bersalah. Menurut penghakiman Mahkamah, beliau telah diminta untuk berbohong bagi memastikan Karthigesu didapati bersalah. Read more
