PETALING JAYA: Ahli Parlimen Seputeh Teresa Kok berkata sukar untuk frasa “rogol dalam perkahwinan” digunakan sebagai terma undang-undang dan untuk dihujahkan di mahkamah.
Katanya, kali pertama beliau tahu mengenai kesukaran itu ialah ketika menjadi ahli Jawatankuasa Pemilih Semakan Kanun Keseksaan dan Kanun Prosedur Jenayah.
“Kami dapati agak sukar meletakkan terma rogol dalam perkahwinan dalam undang-undang. Itu sebabnya ia menyatakan tindakan suami mencederakan isterinya dengan tujuan melakukan seks adalah kesalahan di bawah Seksyen 375A Kanun Keseksaan,” katanya.
Kok berkata sukar untuk membuktikan rogol dalam perkahwinan bila ia berlaku.
“Bagaimana hendak membuktikan ia rogol dalam perkahwinan? Sangat sukar untuk menggambarkan dan berhujah di mahkamah dan sebab itu kami letak ia di bawah 375A di mana hukuman penjara boleh dikenakan hingga 5 tahun.
“Secara tidak langsung ia meliputi insiden keganasan termasuk rogol dalam perkahwinan,” katanya kepada FMT.
Beliau berkata demikian sebagai respons kepada gesaan Pertubuhan Bantuan Wanita (WAO) supaya rogol dalam perkahwinan dikategorikan sebagai jenayah. Read more

KUALA LUMPUR, Aug 25 — The federal government is challenging a court ruling ordering payment of RM350,000 in compensation to DAP MP Teresa Kok over her arrest and detention under the Internal Security Act (ISA), her lawyer said today.
Sankara Nair confirmed that the Attorney-General’s Chambers was not merely appealing against the Court of Appeal’s RM350,000 award, but was appealing against the “entire decision” last July which found the government liable for the opposition lawmaker’s wrongful arrest and detention in 2008 under the ISA that has since been abolished.
He confirmed that the AGC had filed its notice of motion seeking leave to appeal at the Federal Court and served it today on Kok’s lawyers.
“We will be prepared to defend the appeal because I think the law on it is very settled and the facts on it are not disputed,” he told Malay Mail Online when contacted today.
Sankara said his client was “quite disappointed”, pointing out that the Court of Appeal had already taken the time to consider arguments from all parties to give a detailed judgment.
“Since the decision is sound in my opinion with well thought-out and clear reasoning by the Court of Appeal, it would seem quite unfair for the AG’s Chambers to appeal,” he said.
The 30-day deadline for the government to appeal the July 26 decision by the Court of Appeal ends today. Read more

The Attorney-General’s Chambers today withdrew the sedition charge against DAP lawmaker Teresa Kok for her “Onederful Malaysia CNY 2014” satire last year.
Kok expressed her gratitude to Attorney-General Tan Sri Mohamed Apandi Ali, but added that from the outset, she should not have been charged at all as there was no justifiable basis.
Kok said her right to freedom of speech was violated when she was charged in May last year.
“It is also crystal clear that the video was a satire and was innocuous and harmed no one, or any section of our community in Malaysia and hence it was not seditious,” she said in a statement. Read more
