PETALING JAYA: A law expert has joined in the chorus of critics that have dissected the controversial stand of former chief justice Ahmad Fairuz Sheikh Abdul Halim that Islamic law takes precedence over civil legislations in Malaysia.

Abdul Aziz Bari said Fairuz’s way of interpreting the Federal Constitution was both weird and convoluted.

“I just wonder what types of approaches and rules he used in interpreting the Federal Constitution while on the bench,” he told FMT.

“Contentions that have far-reaching implications such as those made by Ahmad Fairuz must be made through constitutional amendments by Parliament,” he said.

He said it would not be enough even if it was made in the course of judgment in court by the judges.

“What more by a retired judge who chose to keep quiet on the matter when he was in office,” he said.

Aziz said this in response to a lecture by Fairuz, who was the chief justice between 2003 and 2007, titled “Islam as the Law of the Land”. In it, he had interpreted the constitution in a manner that made Islamic law the second most supreme legislation in Malaysia. Read more

PETALING JAYA: Kriteria pelantikan ke dalam Dewan Negara seolah-olah menyimpang daripada objektif digariskan Perlembagaan Persekutuan, kata pakar undang-undang dan menegaskan ia kini mejadi tempat untuk kroni kerajaan atau parti.

Dr Abdul Aziz Bari berkata, Dewan Negara, sebagai komponen ke-2 Parlimen, adalah untuk ahli masyarakat yang tidak boleh dipilih ke Dewan Rakyat.

Dan ini katanya, termasuk wakil kumpulan minoriti seperti Orang Asli, pesara atau kumpulan profesional.

Tetapi Aziz menegaskan Dewan Negara kini nampaknya menjadikan ia tempat untuk kroni kerajaan atau parti.

Beliau berkata demikian sebagai mengulas pelantikan 6 pemimpin Umno termasuk Naib Ketua Pemuda Umno Khairul Azwan Harun, kepada Dewan Negara. Read more

SHAH ALAM: The Yang diPertuan Agong should rise above the politics of the country and play his role to safeguard the interest of the nation, said constitutional law expert Abdul Aziz Bari.

Referring to a statement released by the Prime Minister’s Office (PMO) on the matter of Dr Mahathir Mohamad presenting the Citizens’ Declaration with 1.4 million signatures to the Agong on Sept 15, Aziz said there was a definite conflict of interest.

“As the father of the nation, the Agong should not be dragged into this. Ideally, the Agong should rise above politics and play his role, because I think the nation is in a chaotic situation.

“What is the attitude, or the stance of the Agong in particular, and the Conference of Rulers as a whole, as this is a matter involving the prime minister?

“So I don’t think he (Prime Minister Najib Razak) is the right person to speak on the Agong’s behalf,” Aziz said at a forum on The Federal Constitution and the Powers of the Royal Institution here last night. Read more

Pandangan Majlis Raja-raja Melayu mengenai beberapa peruntukan dalam Rang Undang-undang (RUU) Majlis Keselamatan Negara (MKN) 2015 perlu diperhalusi kerana ia memberi implikasi politik cukup besar yang boleh membawa padah kepada Datuk Seri Najib Razak, kata Dr Abdul Aziz Bari.

Pakar Perlembagaan itu membuat perbandingan terhadap RUU 1983 yang meminda Perlembagaan Persekutuan dengan melangkaui tugas Yang di-Pertuan Agong dan memberi kuasa kepada perdana menteri untuk mengisytiharkan darurat.

RUU itu diluluskan di Dewan Rakyat dan Dewan Negara.
