KUALA LUMPUR, Feb 18 — Putrajaya should seek the formation of a new parliamentary select committee (PSC) to look into yesterday’s call by the Conference of Rulers to refine certain provisions in the National Security Council Bill 2015, Bersih 2.0 said.

The polls watchdog’s chairman Maria Chin Abdullah said the call by the royal council mirrors concerns raised by many Malaysians over the vagueness of the law.

She added that a more thorough consultative process should be conducted in Parliament before more decisions are made regarding the law.

“I believe that what the rulers have said should be taken as advice and for the government to take heed and take action.

“They have given good advice. It’s not for the rulers to be directly involved in law-making but it’s now the role and responsibility of the government to do the right thing to correct a bad law that they have bulldozed in Parliament,” she told Malay Mail Online when contacted. Read more

Pandangan Majlis Raja-raja Melayu mengenai beberapa peruntukan dalam Rang Undang-undang (RUU) Majlis Keselamatan Negara (MKN) 2015 perlu diperhalusi kerana ia memberi implikasi politik cukup besar yang boleh membawa padah kepada Datuk Seri Najib Razak, kata Dr Abdul Aziz Bari.

Pakar Perlembagaan itu membuat perbandingan terhadap RUU 1983 yang meminda Perlembagaan Persekutuan dengan melangkaui tugas Yang di-Pertuan Agong dan memberi kuasa kepada perdana menteri untuk mengisytiharkan darurat.

RUU itu diluluskan di Dewan Rakyat dan Dewan Negara.

Datuk Ambiga Sreenevasan said today Prime Minister Datuk Seri Najib Razak took an “opportunistic view” to claim that the National Security Council (NSC) law would help Putrajaya deal with terror threats following the Jakarta bomb attacks.

Speaking on behalf of the #TakNakDiktator coalition, she said the movement was shocked and appalled by Najib’s remark as Indonesian authorities did not fall back on special laws like NSC Bill to curb the security threat.

“The Indonesian authorities treated the terror attack as a law-and-order issue and it was dealt with swiftly and professionally.

“The Indonesian authorities did not use powers akin to an emergency or any powers remotely similar to the NSC Bill to declare a ‘security area’ for six months in order to take control of the situation.” Read more

The controversial National Security Council Bill (NSC) is a serious threat to Malaysia’s constitutional government, said lawyers’ groups in an open letter, as it upsets the separation of powers between executive, legislature and judiciary.

The open letter to Prime Minister Datuk Seri Najib Razak comes as Putrajaya attempts to push through the bill despite widely held concerns from civil society and opposition parties towards the new law.

The groups, who represent lawyers from the peninsula and East Malaysia, also refuted Putrajaya’s claims that the bill was necessary to deal with terrorism and incidents such as the 2013 Lahad Datu incursion by Sulu militants.

“It is apparent that the bill vests and concentrates enormous executive and emergency powers in the NSC and the prime minister,” said the statement signed by the Malaysian Bar, Sarawak Advocates’ Association and the Sabah Law Association.

“This upsets the delicate separation of powers in the constitution between the executive, legislature and judiciary on the one hand, and the constitutional monarchy on the other hand.”

The letter was signed by Malaysian Bar president Steven Thiru, Sarawak Advocates Association president Leonard Shim and Sabah Law Association president Brenndon Soh. Read more

Malaysia akan semakin mundur daripada segi hak asasi manusianya jika Rang Undang-undang (RUU) Majlis Keselamatan Negara (MKN) 2015 dijadikan sebahagian undang-undang negara, kata Pengerusi Suruhanjaya Hak Asasi Manusia (Suhakam) Tan Sri Hasmy Agam.

Dalam satu wawancara sebelum berakhirnya tempoh perkhidmatan beliau pada April, Hasmy berkata, beliau melihat hak asasi manusia di negara ini sekurang-kurangnya sejak 5 tahun lalu sehingga kini, tidak menyaksikan perubahan besar.

Ini kerana, langkah positif yang diambil seperti memansuhkan Akta Keselamatan Dalam Negeri (ISA) kemudiannya dibatalkan dengan penggubalan undang-undang baru yang menyekat kebebasan awam.

Komen Hasmy ini mengungkapkan satu tahun yang gelap daripada segi hak asasi manusia di Malaysia ketika Putrajaya mengukuhkan lagi undang-undang yang menyekat kebebasan bersuara dan pihak berkuasa mengambil tindakan keras terhadap pengkritik pentadbiran Najib.

“Setakat ini, kita (Malaysia) tidak banyak melakukan perubahan besar. Walaupun terdapat beberapa perkembangan positif seperti pemansuhan ISA, terdapat juga perubahan yang meletakkan kita jauh ke belakang dalam hak asasi manusia. Read more

1. The triple whammy of laws for more power and less rights

Malaysians were taken by surprise and slapped rudely with a law where the government — backed by the full force of the state — will have Emergency-like or warzone-like powers against its citizens.

This law is aimed at securing a hazily-defined “national security” for the good of Malaysians, especially when there is a threat in an area that can be unilaterally declared a “security area” by the prime minister on the advice of the National Security Council. Read more

National Security Council Bill 2015: Undermining Parliamentary Democracy – Ambiga Sreenevasan

TakNakDiktatorThe Senate (unsurprisingly) passed the National Security Council Bill 2015. This, despite Senators from both sides of the political divide voicing a range of concerns about it. That did not stop the government from pushing the Bill through without compromise.

Lawyers and activists across the nation have been warning for weeks of the dangers of the Bill and how it violated the Federal Constitution and the sanctity of the rule of law. It would have been in the interests of the nation to have had further discussion on it. Yet the government remained stubborn and did not even show a willingness to listen to reason. What we had was a government acting in haste, willing to overlook clear constitutional and legal impediments to the Bill, and taking the attitude that they know best. This should have triggered alarm bells. It was therefore irresponsible to say the least, to deliver them this Bill, unaltered.

Make no mistake. This Bill gives absolute power to the Prime Minister to declare an area a “security area”. Once an area has been declared a “security area” it becomes a legal black hole. Anything can be done there by the security forces including arrest, seizure of property and even killing, without any of the usual legal safeguards.

“It is absolutely untrue that the Prime Minister has absolute power” thundered the Bill’s proponents. But the clear wording of the Bill contradicts them. They are set out below for the readers to judge for themselves. Read more

Dewan Negara luluskan RUU Majlis Keselamatan Negara

Dewan Negara hari ini meluluskan Rang Undang-undang (RUU) Majlis Keselamatan Negara (MKN) tanpa pindaan yang dikritik kerana memberi kuasa penuh kepada perdana menteri.

Dengan undian majoriti menyokong, rang undang- undang itu‎ memberikan kuasa kepada anggota MKN yang diketuai Perdana Menteri Datuk Seri Najib Razak untuk mengarahkan penahanan mana-mana individu tanpa waran apabila sesuatu kawasan diisytiharkan sebagai kawasan keselamatan.

Menteri di Jabatan Perdana Menteri Datuk Seri Shahidan Kassim ketika penggulungan bacaan RUU itu berkata, kerajaan bersedia menerima kritikan orang ramai yang memberi pandangan secara tafsiran dan ilmiah dan ianya wajar dibetulkan.

“Setelah ambil kira saya memberi pengakuan kerajaan akan mempertimbangkan sebaik- baiknya.

“Sekiranya ada kelemahan kerajaan akan kemukakan pindaan akta ini dalam sesi Parlimen akan datang,” katanya Shahidan ketika menggulung RUU MKN di Dewan Negara hari ini. Read more
